The divorce process in Alberta typically begins with filing a Statement of Claim for Divorce and requesting remedies in relation to property, children, and spousal support. This process can begin prior to the one year date of separation, however, a divorce judgment is typically obtained after the one year date of separation.
The courts utilize the best interests of the children to determine parenting time and decision making. Parenting time is the amount of time the children are physically in either parent’s care and control. Decision making is in regards to the decisions for the children including health care, travel, school, daycare, and others. Decision making is typically jointly shared between both parents.
The amount of child support is determined based on the income of both parents, the number of children involved, and the parenting time arrangement.
In certain circumstances, grandparents are able to obtain court orders in regards to guardianship and/or contact with their grand children.
